Klein, Thorpe & Jenkins guided Morgan County, Illinois, through updating its Wind Energy Conversion Systems Siting Regulations Ordinance and zoning hearing procedural rules.
We then represented the County during the public hearing and zoning entitlement process for $400 million capital investment in 100+ wind turbines and infrastructure improvements to be located on a 36,000-acre site with an estimated $241 million in direct economic benefits to the local and regional area; negotiated and drafted Project Siting Approval Permit Ordinance, Decommissioning Agreement and Decommissioning Plan, Road Use Agreement and Project Security consisting of Cash Escrow Agreement, Irrevocable Standby Letter of Credit and Decommissioning Bond (Performance and Payment Bond).
